Your privacy is important to us. To better protect it, we’ve provided this notice explaining our information practices and the choices you can make about the way your information is collected and used. To make this notice easy to find, it’s available on our homepage and at every point where personally identifiable information (“PII”) may be requested.

The Types of Information We Collect

This notice applies to all information collected or submitted on the Are You In My Photo LLC website. On some pages, you can sign up for memberships and contests, submit photos, leave comments, or vote for your favorite photos. The types of PII collected on these pages are:

IP Address of Your Computer user name Email address

If we offer free merchandise such as bumper stickers, we will ask for your mailing address to send it to you. You can decline to receive these offers if you’re not interested. The Way We Use Information

Our primary goal in collecting your PII is to provide you with a personalized, relevant, user-friendly experience on the Are You In My Photo site. We do not share this information with outside parties except to the extent necessary to provide you with these services, and only with our agents or other people who have confidentiality obligations to us. For example, we may share your PII with credit card authorization companies, our attorneys or point-of-sale payment processing entities. The one exception: we may use your PII to meet our own legal obligations (see below).

These third parties don’t keep your information or do anything with it—we share it only to provide you with the services you request.

We use your information to communicate with you. We may use your email address to inform you of site improvements and special features. If you don’t want to receive these types of communications, you can opt-out when you register to use the site or at any time after that by changing your preferences in the “Your Account” page under “Edit your profile.”

We use your information to send you free merchandise and prizes. We may offer free merchandise such as bumper stickers to site users. We will always ask you first if you would like to receive these items. We will also use your information to send you your prize if you win a contest.

We use your IP address to help us provide you with better services: An IP address is literally your computer’s address and is a unique identifier, allowing online information to be sent to the right place. We use IP addresses to better understand the customer database. We use your IP address to help diagnose problems with our server and to administer our Web site. We never intentionally link your IP address to your PII.

We use cookies to help our site remember who you are: Contrary to popular belief, cookies do not automatically extract private or personal information from your computer’s memory. The job of a cookie is to record only the information you volunteer to us upon registering or visiting the site. Cookies are tiny files placed onto the hard drive of your computer the first time you visit our Web site that allow our server to recognize or “remember” who you are next time you come back. Are You In My Photo cookies are not tied to your PII. For instance cookies may be used to retain your personal preferences, hold session information for a “shopping cart” or save your password so it doesn’t have to be re-entered each time you log in.

Advice on Limiting Cookies: You always have a choice with respect to cookies. By modifying your browser preferences, you can accept all cookies, be notified when a cookie is set or reject all cookies. If you choose to reject all cookies, you may be unable to use certain Are You In My Photo services. Please consult your browser instructions for information on how to modify your choices about cookies.

We use your information to meet our own legal obligations, if necessary. We don’t anticipate it happening, but if Are You In My Photo is required by law (or to protect its own rights or property), we will disclose your PII to the extent so required.
Our Commitment To Data Security

What we do to keep your data safe: To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we use many physical, electronic, and managerial procedures to safeguard and secure the information we collect online. For example, SSL encryption technology is used when processing any payment transactions and anti-virus and firewall software is monitored and updated regularly on the servers we use. We’ve got locks on our doors and there are “locks” on the network, to help you feel safe about the security of your information.

Data security is also a partnership. Your personal information is password protected and we strongly recommend that you never share your password. Try creating a strong password that includes both capital and lower-case letters, numbers and characters. Don’t use obvious passwords like your birth date or children’s name. We also recommend that you change your password every three months.

What we do with your data after we’re finished with it: Hopefully, this is the beginning of a long and enjoyable relationship. Therefore, we will retain all non-financial PII (e.g. your name and email address) on secure servers for the length of your membership. Hard copies of any information will be shredded and we will use comparable “shredding” technology on our servers.

Finally, if you cancel your membership, we may be required by certain rules and regulations to keep financial information concerning payment transactions and the like for a longer period of time. We will do so and then destroy it as described above.

What we do if there’s a problem: Although we’re quite sure this will never happen, if our security is breached and your PII is accessed or vulnerable, we will notify you immediately in accordance with several state law reporting procedures.
Our Commitment To Children’s Privacy

Protecting the privacy of the very young is especially important. For that reason, we never collect or maintain information at our website from those we actually know are under 13, and no part of our Web site is structured to attract anyone under 13.
How You Can Access Or Correct Your Information

Whenever the site is up and running, which will be as close to always as we can make it, you can access all the PII we collect and maintain. Just sign into your account and, if need be, correct any errors or update your information by clicking on the “Your Account” link and then clicking “Edit your profile”. You may be required to re-enter your user name and password before changing your account information. We use this procedure to better safeguard your information.
Beware Hackers, Phishers, Spammers and Other On-Line Baddies

Are You In My Photo will never ask you for your password or financial PII in an unsolicited phone call or in an unsolicited email. If you receive an email that appears to be from Are You In My Photo asking you for this information, you are probably being “phished” (tricked into giving out financial or personal information). Do not respond to this email and delete it immediately. For more information on spotting frauds and phishermen, go to the FTC Web site at www.ftc.gov.
Notification of Change

If we are going to use your PII in a manner that is materially different from that stated in this policy, we will notify you via email. You will have a choice as to whether or not we use your information in this different manner. In addition, if we make any material changes in our privacy practices that do not affect user information already stored in our database, we will post a prominent notice on our web site notifying users of the change. In some cases where we post the notice, we will also email users who have opted to receive communications from us, notifying them of the changes in our privacy practices.
